TERMS AND CONDITIONS OF MEMBERSHIP
1.
The only responsibility of GREEN THEME INTERNATIONAL, LLC (GTI) - HOME EXCHANGE HOLIDAYS
is to maintain an on-line database of its members. The information held in the database is
provided by the members, and GREEN THEME INTERNATIONAL, LLC makes no warranty,
either expressed or implied, about the information provided. The entire contents of the database and
web-site are Copyright of GREEN THEME INTERNATIONAL, LLC. All rights reserved. No
parts of this web-site or associated documentation and data may be reproduced in any form without
written permission from GTI.
2.
GTI
is an introduction agency. Accordingly, neither GTI nor its Representatives
offer any guarantee and make no warranty that the Exchanger will find an
exchange with a compatible Exchange Partner, and that a home exchange will
result. The annual membership fee is
paid for 12 months of membership of Green Theme International. The membership fee is paid on a non-refundable
basis.
3.
It
is not possible for GTI or its Representatives to inspect the houses of
Exchangers registered with it.
Accordingly neither GTI nor its Representatives accept any
responsibility or liability for the quality, fitness for purpose or state of the
Exchange Partner’s home, nor can GTI or its Representatives accept any
liability for any damage, accident or injury which might occur to the Exchanger
or any member of his family, or any person accompanying the Exchanger to the
Exchange Partner’s home, or to whom the Exchanger allows access whether as
visitor, tradesman or otherwise.
4.
Neither
GTI nor its Representatives are responsible for agreeing the terms and
conditions of any agreement between the Exchanger and the Exchange Partner,
subscribers, or other users of information provided on this web-site. Any such agreement is a matter between the
Exchanger and the Exchange Partner, whether as to such terms as allowing the
Exchanger into the Exchange Partner’s home, or vice versa, or any accident or
damage which may occur to either home or any person occupying or visiting
either home during the period of the home exchange, or the giving up of
possession at the end of the home exchange.
5.
Only
the Exchanger and the Exchange Partner are aware of their own particular
circumstances and requirements, and accordingly only they can agree terms
suitable for their needs and circumstances.
Neither GTI nor its Representatives accept any responsibility or
liability for any agreement (or lack of it) between the Exchanger and the
Exchange Partner. If the Exchanger has
any concerns or doubts about, or does not fully understand any term of any
agreement or proposed agreement between himself and the Exchange Partner the
Exchanger should seek professional legal advice about such agreement or
proposed agreement.
6.
The
Exchanger is solely responsible for ascertaining if the Exchange Partner, his
family and any persons accompanying him on the home exchange are suitable and
trustworthy persons to allow into occupation of the Exchanger’s home. The Exchanger is recommended to ask for
references if appropriate. Neither GTI
nor its Representatives accept any responsibility or liability for any acts or
omissions of the Exchange Partner, his family and any person accompanying him
whilst in occupation of the Exchange Partner’s home.
7.
The
above stated TERMS AND CONDITIONS shall be construed in accordance with the
laws of the United States. By
maintaining individual membership of GTI, members consent to the subject matter
and to the jurisdiction of the United States courts.
8.
These
Terms and Conditions of individual membership and home exchange, including but
not limited to all applicable fees, may be changed from time to time by GTI at
its sole discretion. Members will be
provided advance written notice of any such changes.
IMPORTANT RECOMMENDATIONS
1.
Neither
GTI nor its Representatives can be responsible for any damage, crime or
accident to or at the Exchanger’s home, and the Exchanger is solely responsible
for all damage caused by him or his family or anybody accompanying him on a
home exchange, or whom the Exchanger allows to enter the Exchange Partner’s
home whether as visitor, tradesman or otherwise. Accordingly, the Exchanger is strongly recommended to check that
he has or obtains adequate insurance for his home, and that the terms of any
home insurance policy will provide insurance against all usual risks during the
period of the Exchange Partner’s occupation of the Exchanger’s home. The Exchanger is also strongly recommended
to ensure that he has, for himself, his family and anybody accompanying him,
adequate third party and public liability insurance for the period of the
Exchanger’s occupation of the Exchange Partner’s home, to provide cover in the
event of any damage thereto, or any accident to any person entering or
occupying the Exchange Partner’s home.
2.
The
Exchanger is strongly recommended to obtain adequate travel insurance for the
period of the home exchange, to provide cover for the Exchanger, his family and
any person accompanying him on the home exchange for all normal travel risks
including delay, cancellation, loss or damage to possessions, accident, death
or injury including medical expenses, and any duty the Exchanger may owe or
possible liability to the Exchange Partner.
3.
The
Exchanger should check the bona fides of the Exchange Partner, his authority to
allow the Exchanger into the Exchange Partner’s home and trustworthiness. If appropriate the Exchanger should require
evidence of the Exchange Partner’s authority into his home and references to
establish the Exchange Partner’s bona fides.
4.
If
the Exchanger is in doubt about any terms of any agreement with the Exchange
Partner or the Exchange Partner’s bona fides or authority to enter into such
agreement the Exchanger should seek appropriate legal or other professional
advice.
DEFINITIONS
In the preceding Terms and Conditions, and Recommendations, the
following terms and expressions shall have the following meanings:-
1.
“The
Exchange Partner” shall mean the person or persons whom the Exchanger proposes
to allow to occupy his home for a predetermined exchange period.
2.
“The
Exchange Partner’s home” the building, house, flat or property which the
Exchange Partner allows the Exchanger to occupy, or proposes to allow to
occupy, pursuant to any agreement or proposed agreement between the Exchanger
and the Exchange Partner.
3.
“The
Exchanger’s home” the building, house, flat or property which the Exchanger
allows the Exchange Partner to occupy, or proposes to allow to occupy, pursuant
to any agreement or proposed agreement between the Exchanger and the Exchange
Partner.
4.
“The
home Exchange” an agreement between the Exchanger and the Exchange Partner to
allow each other into occupation of their respective homes.
5.
“The
period of the home Exchange” the period of time for which the Exchanger and the
Exchange Partner allow each other into occupation of their respective homes.
6.
In
these Terms and Conditions, any word or expression carrying the masculine
gender shall include the feminine and vice versa and the expressions “his/hers:
he/she: him/her shall be construed accordingly.
